What due diligence does an insurance company need to do to cancel a policy?

by Kelly Handler
(Toronto, Ontario)

My insurance company cancelled my policy and I had no idea this was done, I was driving literally for months not knowing it was cancelled. They say they phoned me twice and sent me a registered letter, and also showed me a canada post letter indicating that the letter was returned to them undeliverable. So, the it was clear that I was not notified. The problem now is that I was involved in a very minor accident to which I'm being named as a defendant. I've brought a third party claim against my insurance for them to defend me, but they're fighting this. Did they pursue the proper due diligence to notify me of this cancellation? I appreciate any input you may offer.

Notification of Cancelled Policy

This is something for you to ask a lawyer. Please be sure to get proper legal advice

That said ... What are they supposed to do if you haven't provided your up to date contact information and address? And you should have noticed that no payments were coming out of your account. Sorry to be harsh when you're having a tough time, but I don't see what the insurer should be doing.

Be sure to hire a lawyer to help you in this.
