Theft by a guest and insurance

by Vero
(Ottawa, Ontario, Canada)

I've have been insured with the same company for years... Last year my dad's gf lost her apartment (dad lives with us). Her stuff was moved in about 2 months before she showed up. She lived with us for a few months because she was hurt and on an IV, but never had independent access (no keys or alarm codes), and was never left in the house by herself. After Christmas when she was mobile again, she became more erratic, and was gone more often than she was here, and stopped coming over in mid-February. In May, I discovered that almost all of my jewelry was stolen, as well as a few electronics (psp, ipod. It was stuff that I hadn't worn a lot, but it meant a lot to me.

Anyway, I reported it to the police, and she was charged and incarcerated (I found a single ring in a pawn shop). I called my insurance company as nothing was recovered, but they now say that I am not covered because she was a guest in my house. I called believe that just because someone was invited into the house that I'm not protected- that's nuts!

Do I have any alternatives available??

Theft by and Guest and Insurance Coverage

Hi Vero,
This is a tough one. It really depends on the exact circumstances and the exact policy wordings.

It could be that the girlfriend was considered a common-law spouse and was therefore insured on the policy. Theft by an insured would be excluded.

There are other possibilities including that the policy definition of theft states that theft by a guest is not covered.

The policy wordings must be carefully reviewed to see if the decision is correct. Perhaps a lawyer should be hired.
