Smoke/Odour damage

by Robert
(Ontario, Canada)

I have been the victim of my neighbor's negligence. My neighbor left a candle going and went to bed, subsequently igniting his dining room table. He also disconnected his smoke alarms a few weeks prior to the incident. The smoke filtered up to my condo and my unit received smoke/odour damage to the extent that I have been displaced to a hotel until the restorer's can return my unit to a livable space. I have initiated a claim through my insurance, and the neighbor has done the same through his insurance. The Condo corp has also initiated a claim through their insurance.
Since my neighbor was 100% negligible, and I am a victim in this incident, Is my insurance affected in the end, for example, will my premiums be affected? Shouldn't this be going through my neighbor's insurance?

Fire in Condo Below and Smoke Damage

Hi John
Your rates might go up as you will likely lose a claims free discount. And if you have too many claims in a short period (ie 3 in 3 years) your policy could be cancelled. Depending on your insurer of course.
