Removing past accident when 0% at fault.
by Doug E
(Brockville, Ontario)
Nine years ago I lived and worked in Ottawa, Ontario as a Mobile Security Supervisor.
During one shift, another driver ran a red light and totaled the work vehicle.
He confessed to the police about running a red light, accepted full responsibility, and plead no contest to dangerous driving.
My employer claimed the accident to his insurance, but used my name in the claim without my knowledge or consent.
Six months after I quit, my now former employer was charged and convicted of fraud, and the security company I worked at was promtly dissolved.
Even now when trying to obtain insurace for a vehicle, the companies try to tell me that I had a claimed accident from 2002, and because of that my rates will be higher. I then have to explain to them that I was 0% at fault, my employer used my name without my consent, and I live no where near Ottawa anymore. Even after explaining this, my rates will more than likely still be higher.
So my question is, how do I go about removing the existance of my 0%-at-fault accident so I no longer have to pay extortion-rates to an insurance company?
I remember one company telling me that the only people who can remove the past claim is the person with the original policy. The policy in question was to the security company, which hasn't been running since 2003. So there has to be another way to remove this crap.
Old Claim Causing Problems
Hi Doug
Thanks for the question. That is a frustrating situation.
With most carriers, if a claim is over six years old it has no effect. Some go ten years. And if it is not at fault then there should be no impact. I am not clear: were you driving the vehicle? If so there is nothing wrong with noting that you were involved in the accident. The problem lies with the fault.
It sounds like something has been recorded incorrectly. This can only be fixed by the insurer who insured the company at the time. Contact them to get this corrected.
One comment, I don't get why this hasn't impacted you until now?

This is from the company that handles most of the reporting submitted by insurers.
Good luck!
