Insurance Question:
my car was parked it was uninsured,it was hit in the middle of the night by an insured car,can i go after his insurance to pay for the damages?
Answer
You can go after his insurance to pay for the damages. His insurance would include liability coverage for property damage.
As indicated on the Canada Insurance Ontario page, this would typically fall under your DCPD coverage (Direct Compensation Property Damage)
DCPD makes claiming much easier than it will be for you. Under Ontario's "No Fault" insurance DCPD allows you to go straight to your insurer. Now you have to go after him and his insurance which might be a frustrating process.
Good luck with this!
