neighbour hits fence in snow
by Mary-Lou
(Dundas, Ontario, Canada)
My neighbours kid drove into my fence during a period of snow. I found the post broken when I came home from work.I spoke to the neighbour, who is not a nice person, that is why I have a fence. The fence is on my property and 20 feet from the road. How do I get the neighbour to fix my fence? Do I have to go through my home insurance or can I take them to small claims court if they refuse to pay for the repair?
My deductible will be higher than the cost of the fence repair.
Neighbour Hit Fence
Hi There,
This is covered by your home insurance, subject to a deductible. It is also covered by your neighbours auto insurance.
Can you prove the neighbour did it? Is there a police report or other evidence? That would help if you went to small claims court. That is probably where you will end up if the neighbour won't cover it.
