My Uninsured Parked Car Was Hit - Can I claim against the insured driver ?

I had my car parked on the street, legally, but decided to pull of the insurance as I wasn't using it at the time. An insured driver collided with it while it was parked, pretty much writing it off.

My insurance company understandable will take no responsibility, but can I go after the insured - at fault - drivers company as a 3rd party claim ?

Yes, you can "go after" the insured that hit you. Their liability portion covers property damage.

That said, I doubt that anyone on the other side is going to be very helpful. You will likely have to hire a lawyer and initiate a lawsuit. I doubt it would go to court, once legal proceedings are initiated the other party's insurer will likely want to settle.

If it's not too late, a police report could be very helpful to you. Witnesses and pictures will also help.
