Life insurance beneficiary, family is contesting....
by Carleen
(Calgary, Alberta, Canada)
I was common law with my ex for about a year and a half. He lied multiple times and we broke up because of this. He passed away a couple of months ago, and I found out he had me as his beneficiary from his life insurance at work. He apparently changed it from his mother to myself, at a time he was healthy and of sound mind and body. There was a mix up at the beginning and his company did not have the updated information, and thus sent his mother the notification that she was beneficiary. They then had to turn around when the insurance company had the most updated information, myself as named beneficiary, and retract her as beneficiary. She is now contesting the validity of the fact that her son named me. He has a son, daughter in law and granddaughter that he denied having at the time we went out. And siblings that he was estranged from for a number of years. Along with issues with his mother, whom he didnt speak to for years. What are my chances of actually having the court go in my favor....
Contested Beneficiary on Life Insurance
Hi Carleen
The insurer will pay the benefit to the most recent beneficiary on file. So it is hard to imagine that you would lose in court. But I don't know the whole story and I am not a lawyer. So please make sure that you get legal advice on this.
