family member intoxicated after borrowing vehicle
by Melissa
(London, Ontario)
A family member asked to borrow our vehicle. He was sober when he picked up the vehicle, however, without us knowing, he then went home, had a few drinks and then took our vehicle out again. If he had been stopped he probably would have been over the legal limit. What would the legal implications if he had been stopped by the police or had hit another vehicle or person? Would WE (me and my husband) be responsible or would he? and what would our insurance cover?
Obviously, we will try to prevent this in the future, but I am curious as to the laws surrounding this.
Thank you
Family Member Borrowing Car While Intoxicated
This site does not offer advice, just general opinions, and certainly not legal advice. But I will say that insurance excludes much coverage when the driver is intoxicated (e.g. if car is damaged or destroyed, there is no coverage).
And when you lend your car out that you can be responsible for the driver (e.g. it affects your insurance history).
Please be sure to discuss this further with a licensed insurance representative. Oh, and by the way, are your rates too high? Check here:
