Charged but not Convicted

My husband was coming home from a baseball game. He was stopped by an officer and admitted that he had been drinking. A breathalyzer test showed that he was over the limit and he lost his license for 30 days. We took the matter to court and won, the lawyer charged that the breathalyzer was not functioning properly and caused him to blow over the limit, but the charge is still on his license. How do we get it removed and if we were to shop around for insurance would that cause higher premiums?

Hi Martha,
If you shop around while this charge is on his license your rates will be very high. Many companies will decline to offer insurance. You'll have to follow up with the MTO to get this removed.

It will likely take some persistence.
